This is the final notice that Tenant has to provide the Landlord, which must be complied with by Landlord, prior to the Landlord filing an eviction lawsuit against the tenant. This Notice to Tenant is for all residential tenancies in the City of Albuquerque, New Mexico (excluding the Town of Silver City, New Mexico). This notice is to be given directly to the tenant who is in possession of the premises, which is either the tenant or the landlord. It must be provided within 48 hours after the lease is ended. The notice is a written notice containing both notice to terminate the lease and the effective date of the lease renewal, usually a one-year period. The notice must either state that the lease expires, or state that the tenant and Landlord have agreed to renew the lease. Tenant may choose to vacate the premises or remain on the premises as provided for in the written lease or agree to be renewing the lease with the Landlord on a month-to-month basis.
